520 | _aThis report argues that all boarders and lodgers should be covered under Residential Tenancies legislation through amendments to the Landlord and Tenant (Rental Bonds) Act 1977 and the Residential Tenancies Act 1987 (as amended). Neither acts currently apply to boarders and lodgers. There are around 130,000 boarders and lodgers in New South Wales who are found in different boarding or lodging situations - boarding-houses, residential centres, group homes, boarding in private homes, informal tenancies informal tenancies and hotels and hostels. Many are disadvantaged people, generally on low incomes or with some form of physical or social disability. They face major problems in asserting their rights because they are 'lost in the law'. The thrust of the recommendations centres on defining a 'boarding or lodging situation' and acceptance of a standard form of residential tenancy agreement for landlords and tenants in a boarding or lodging situation which includes a standard form of service contract. It is accepted that a number of provisions in the legislation should vary for different types of boarding or lodging situations and recommendations have been made accordingly. Objections to give coverage under these Acts to occupants in all types of boarding and lodging situations are wither found wanting o are cantered for through the proposed amendments. The Appendix produces a draft Bill and proposes changes to the Regulation which, if enacted, would give boarders and lodgers coverage under both Acts. | ||
